Insurance plans and issuers must annually submit to the Centers for Medicare & Medicaid Services (CMS) an attestation that the plan or issuer is complying with the Consolidated Appropriations Act (CAA) Gag Clause Prohibition Compliance Attestation (GCPCA). The aim of the gag clause prohibition and attestation is to increase transparency in health care pricing and quality information, allowing individuals to make more informed decisions about their health care.

The attestation is due December 31, 2026, and is required annually each year by that date. UnitedHealthcare (UHC) has reviewed all existing contracts for compliance and will attest for fully insured and level funded customers.

Below are details for Fully Insured, Level Funded and Surest cases:

  • UHC will make the attestation to the U.S. Department of Health and Human Services (HHS) portal as required.
  • No action is required by the account team or the customer to attest for their fully insured business with UHC.
  • UHC will respond to any questions on the submission from the government, if any.
  • Surest will follow the same approach as UHC (new for this year).
